Welcome to secondbreath.shop (the "Site"), operated by SecondBreath,. By accessing or using the Site or placing an order, you agree to these Terms of Service. Please read them carefully — Sections 7–9 contain important safety, disclaimer, and liability terms specific to this product.

1. ELIGIBILITY
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from this Site.

2. PRODUCTS & PRICING
We do our best to display products, descriptions, and prices accurately. We reserve the right to correct errors, change prices, and limit or cancel quantities at any time, including after an order is placed. Colors and packaging may vary slightly from images.

3. ORDERS
Your order is an offer to buy. We may accept or decline it. A confirmation email acknowledges receipt but does not guarantee acceptance. We may cancel orders we suspect are fraudulent or that violate these Terms, and will refund any payment taken.

4. PAYMENT
Prices are listed in base currencies; other currencies shown at checkout are conversions. You confirm you're authorized to use your chosen payment method.

5. SHIPPING & RETURNS
Delivery and returns are governed by our Shipping Policy and Refund & Return Policy, which form part of these Terms.

6. INTELLECTUAL PROPERTY
All content on the Site — text, images, logos, and design — is owned by or licensed to us and may not be copied or reused without written permission.

7. PRODUCT SAFETY & INTENDED USE (PLEASE READ)
The Anti-choking device is a first-aid support device intended as a backup for use only when standard choking first aid — back blows and abdominal thrusts (the Heimlich maneuver) — has failed or cannot be performed. It is not a replacement for standard first aid, professional emergency care, or proper training.
By purchasing, you acknowledge and agree that:
- In any choking emergency you will call your local emergency number immediately and, where possible, begin standard first aid first;
- You are responsible for reading all instructions, understanding correct mask sizing and sealing, and ideally completing a certified first-aid/CPR course before you may need the device;
- No airway-clearance device can be guaranteed to remove an obstruction or to prevent injury or death in every situation;
- The device is intended for emergency use by the purchaser and household, not for professional medical or clinical use unless expressly indicated.

8. MEDICAL DISCLAIMER
Nothing on this Site is medical advice, and no doctor–patient or professional relationship is created by your use of the Site or purchase of any product. Information provided is for general educational purposes only. Always seek the advice of a qualified healthcare professional or certified first-aid trainer with any questions about emergency response or your specific circumstances.

9. ASSUMPTION OF RISK & LIMITATION OF LIABILITY
You use the product voluntarily and assume the inherent risks of any emergency-response situation. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages, or for any outcome arising from the use, misuse, or inability to use the product, or from reliance on any information on the Site. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or any statutory consumer rights that cannot be waived. Your mandatory consumer rights under the laws of your country of residence remain unaffected.

10. INDEMNITY
You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the product.

11. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of Lithuania, without regard to conflict-of-law rules, and, where you are a consumer, without depriving you of the protections of the mandatory laws of your country of residence. Disputes will be handled by the competent courts, subject to any consumer-protection venue rules that apply to you. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. CHANGES
We may update these Terms at any time; the "Last updated" date shows the current version. Continued use after changes means you accept them.
